Lead Distribution & Resale Policy
This policy describes how Luxe Residences handles the distribution, assignment, sale, and monetization of leads and data assets collected through its platforms and technologies, including Qrixe®.
Definition of Leads and Data
"Leads" include any personal, contact, property, behavioral, or transactional information collected from users, whether directly or indirectly, including through QR codes, valuation tools, IDX integrations, APIs, public records, or third-party data sources.
Ownership of Leads
All leads and data collected are the exclusive property of Luxe Residences. Users acknowledge they have no ownership, royalty, or compensation rights in such data.
Internal Distribution
Leads may be distributed internally to Luxe Residences agents, teams, employees, contractors, and affiliated brokerages for follow-up, marketing, servicing, or transactional purposes.
External Distribution and Resale
- Luxe Residences reserves the unrestricted right to sell, license, assign, syndicate, or otherwise distribute leads or data assets, in whole or in part, to third parties including:
- Real estate agents and brokerages
- Mortgage, insurance, and ancillary service providers
- Marketing partners
- Data aggregators
- Strategic partners or acquirers
No Exclusivity
Unless expressly agreed in writing, no lead is exclusive to any agent, team, or third party.
No Guarantee or Duty
Luxe Residences makes no guarantees regarding lead quality, accuracy, conversion, or performance and assumes no fiduciary duty to users or recipients of leads.
Regulatory Compliance
Recipients of leads are solely responsible for compliance with all applicable federal, state, and local laws, including TCPA, CAN-SPAM, and state privacy statutes.
Limitation of Liability
Luxe Residences disclaims all liability arising from the use, misuse, resale, or distribution of leads.
Modification
This policy may be modified at any time without notice.
Governing Law
This policy is governed by the laws of the State of Florida.
